Why Texas Employers Require TABC Certification

TABC Safe Harbor may protect a retailer’s license or permit from certain TABC administrative action after an illegal sale or service by an employee when all Safe Harbor conditions are satisfied.

Important employer conditions include:

Current seller/server certificate

The seller/server holds a current certificate from a TABC-approved school.

Certification within 30 days of hire

All employees involved in alcohol sale, service or delivery, and their immediate managers, are certified within 30 days of hire.

Written responsible-service policies

The employer maintains written responsible-alcohol-service policies.

Employees read and understand the policies

The employer ensures employees read and understand those responsible-service policies.

No encouragement of violations

The employer does not encourage employees to violate alcohol laws.

All other requirements must be met

Other statutory and TABC conditions also apply. These training and policy requirements are not the full eligibility test.
